Terms of service

These Terms of Service ("Terms") apply to every purchase from and use of www.marsanicmotorsport.com.au (the "Site"), operated by Marsanic Motorsport ("we", "us"). By using the Site or placing an order you agree to these Terms, together with our Shipping Policy, Return & Refund Policy and Privacy Policy. Nothing in these Terms excludes or limits your rights under the Australian Consumer Law.

1. Using the Site

You must be at least 18 years old to place an order. You agree to provide accurate, current and complete details when ordering and to keep your account details secure. You must not use the Site for any unlawful purpose, attempt to interfere with its operation or security, or copy or scrape its content.

2. Products and fitment

We supply performance and replacement parts for a wide range of vehicles. Product descriptions, images and fitment information are provided in good faith from manufacturer and supplier data; images may show optional extras or a related variant. It is your responsibility to confirm that a part suits your vehicle before ordering, or to give us your vehicle details at checkout so we can check it for you. Our Search by Vehicle tool is a guide only and is not a guarantee of fitment. Fitment-related returns are handled under our Return & Refund Policy.

3. Performance parts, road use and warranties

Many of the parts we sell are designed for performance or motorsport use. Fitting aftermarket parts may affect your vehicle's warranty, insurance, emissions compliance or roadworthiness, and some parts are sold for off-road or competition use only. You are responsible for checking the laws that apply in your state and for ensuring parts are fitted correctly by a qualified person. Manufacturer warranties are provided by the relevant manufacturer on their own terms, and apply in addition to the consumer guarantees that cannot be excluded under the Australian Consumer Law.

4. Prices and payment

All prices are in Australian dollars and include GST unless stated otherwise. Shipping is charged as set out in our Shipping Policy and shown at checkout before you pay. We accept the payment methods shown at checkout, including credit and debit cards, PayPal, Shop Pay, Google Pay, Zip and Afterpay; payments are processed by those providers under their own terms. Prices and availability may change without notice, but changes will not affect an order we have already accepted.

5. Orders and acceptance

Your order is an offer to buy. We accept it when we send you a dispatch confirmation. We may decline or cancel an order before dispatch - for example where a product is unavailable, a price or description was listed in error, we suspect fraud, or the order cannot be delivered to the address given - and if so we will refund any amount you have paid in full. Cancellations requested by you are handled under our Return & Refund Policy.

6. Errors and availability

We work hard to keep the Site accurate, but occasionally a product may be listed with an incorrect price, image, description or stock level. Where we discover an error affecting your order we will contact you before proceeding and give you the choice of continuing at the correct price or cancelling for a full refund. Many parts are supplied to order from our distributors, so availability and lead times can vary.

7. Shipping and risk

Delivery is made to the address you provide, and risk in the goods passes to you on delivery. Please check your parcel on arrival and report any damage or shortfall to us within a few days. Delivery timeframes are estimates and are set out in our Shipping Policy.

8. Returns and refunds

Returns, refunds, cancellations and exchanges are covered by our Return & Refund Policy, which forms part of these Terms.

9. Content, reviews and intellectual property

All content on the Site - including text, images, logos and the Search by Vehicle data - is owned by or licensed to Marsanic Motorsport and may not be reproduced without permission. Manufacturer names, logos and part numbers are used to identify compatible products only and remain the property of their owners. If you leave a review or send us feedback, you give us permission to publish it (without your personal details) and you confirm it is honest and your own.

10. Third-party links and tools

The Site may link to manufacturer websites, videos or other third-party content and may use third-party tools such as payment and review services. We are not responsible for the content or practices of those third parties.

11. Liability

To the extent permitted by law, our liability for any claim relating to the Site or a product is limited, at our option, to replacing or repairing the product or refunding its price, and we are not liable for indirect or consequential loss such as lost time, labour, dyno or tuning costs, or damage caused by incorrect fitting or misuse. This does not limit any guarantee, right or remedy you have under the Australian Consumer Law, including for goods that are not of acceptable quality or fit for their purpose.

12. Privacy

We handle your personal information in accordance with our Privacy Policy.

13. General

These Terms are governed by the laws of Queensland, Australia, and you agree to the non-exclusive jurisdiction of the courts of Queensland. If any part of these Terms is found to be unenforceable, the rest continues to apply. We may update these Terms from time to time by posting the new version on this page; changes apply to orders placed after they are posted.
